ADDENDUM TO RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-02645 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: He be entitled to the award of the Distinguished Flying Cross (DFC). ________________________________________________________________ STATEMENT OF FACTS: A similar appeal was considered and denied by the Board on 11 April 2011. For an accounting of the facts and circumstances surrounding the applicant’s separation, and, the rationale of the earlier decision by the Board, see the Record of Proceedings at Exhibit E. The applicant submitted a request for reconsideration, contending that the decedent should have been awarded the DFC for his meritorious achievement during a bombing mission on 15 July 1945. To support his appeal, the applicant provides a personal statement and a notarized letter from an eyewitness account of his father’s involvement with the mission. The applicant’s complete submission, with attachments, is at Exhibit F. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting corrective action. Subsequent to the earlier decision by the Board, the applicant provided an eyewitness account of the events of that fateful day, 15 July 1945. The eyewitness account notes the decedent’s acts of extraordinary achievement to successfully complete the mission, even after losing an engine. Therefore, in our view, based on the additional evidence provided, we believe this decedent should be entitled to the award of the Distinguished Flying Cross. In view of the above, we recommend the former member’s record be corrected to the extent indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that he was awarded the Distinguished Flying Cross for his acts of extraordinary achievement and heroism, on 15 July 1945, while serving as a pilot and successfully completing a bombing mission against the Japanese Empire. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2010-02645 in Executive Session on 27 September 2011, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
